Hemp stakeholders such as lawmakers and trade organizations, as well as the advocates, are continuing to lobby on matters connected to the interim federal government funding proposal irrespective of the absence of a language creating a pathway for hemp or CBD products.
On Tuesday, the House of Representatives voted on the interim funding bill, and the Senate is scheduled to vote for the measure on Thursday. President Trump is supposed to sign the proposal before Friday to avoid the government being partially shutdown at the beginning of 2020.
No legislative language on Hemp or CBD products are included in the 1,773-pages proposal, irrespective of the campaign conducted by the trade organizations. Senators Mitch McConnell and Jeff Merkley were also in favor of the bill. The bill includes a policy where the federal regulation forestalls funds allocated by lawmakers from being used in the prevention of ferrying, processing, and sale or consumption of hemp products/grains included that are gotten from the hemp crop while adhering to the federal law.
The measure also sets aside $2 million to fund market surveillance, which would be conducted by the FDA, as well as issuing of enforcement discretion policy and other hemp or CBD products related activities. The legislation also has a provision instructing the agency to provide Congress with reports on its progress relating to the regulation of the products 60 days after its enactment. The bill also under instruction to carry out a sampling study determining the extent of consumption of hemp and CBD products by the adults in the marketplace. The said study is to be completed within 180 days.
The president of the United Natural Products Alliance (UNPA) Loren Israelsen said that people and businesses were disappointed by the agency’s intentional omission of the legislative language relating to hemp and CBD. Israelsen also noted that advocates of the prohibition of these products usage and liberalization of the rules are not throwing in the towel.
In a memo to UNPA, Israelsen said that although a regulatory pathway resolution is absent, efforts by the FDA and opposers of a consumer market for HEC have been efficient and convincing in imparting doubts on the staff and members of the Congress.
UNPA conducted a legislative analysis that showed that the latest setback in the interim federal rules is part of the recent trends on hemp and CBD regulation. On November 25, a warning was issued against the use of hemp or CBD products by pregnant and lactating women.
On Monday, the president and CEO of Natural Products Association, Daniel Fabricant, said that the funding bill language omission amounts to what is referred to as a dangerous legislative vacuum by the NPA.
Fabricant said that even though financing hemp testing is a step in the right direction, the bill fails in protecting the consumers. He also noted that if Congress does not act promptly during the 2020 legislative sessions, then the U.S can experience another health-related outbreak.
These sober warnings about the absence of hemp and CBD legislation should be welcome news to hemp industry actors like MCTC Holdings Inc. (OTC: MCTC) and SinglePoint Inc. (OTCQB: SING) since they have always decried the lack of CBD regulations.
